Holding that the lower court erred in assuming there was no evidence and dismissing the case. In a case where avoidance is a distinct fact, the defence must have the oppurtunity to prove this. A party that aver but are ready to prove sums paid in consideration must be proved to "render them inoperative to support the presumption of law, until prrof the the contrary is offered."
