Short Summary: | Effectiveness of an invalid will in establishing a defendant's title to land. There was a plank partition made subsequently to this will that was approved by the testator. The original will giving freedom to a "white slave" (Charity Hutchins) on the condition that she pay $3 a month to for three years to the testator's brother. The will also gave freedom to another slave (Rachel). Holding that instances where the testator does not desire a fraft of a will to be referenced in law should not be used in evidence. |
