Party alleges that she "gave up" bonds on refusal to tender payment and stating that her "lockett was the only property she has." Holding that the wife sufficeintly gave up her notes and bonds in the presence of her husband. Giving possession to Crane and using marriage as consideration, Crane obtained legal title. The statute of frauds is not implicated if it is not objected to at the first chance, a statute of frauds claim can not be invoked on appeal.
